민주노총 공공운수노조 화물연대본부(위원장 김동국, 이하 화물연대)가 안전운임제를 위반하고 불법 수수료를 징수하는 악질업체들에 대해 지자체의 엄정한 행정 처분을 촉구하고 나섰다.
화물연대는 7일 오전 11시 전북도청과 부산시청 앞에서 동시에 기자회견을 열고, 안전운임 위반 현황을 고발하는 한편 이 같은 불법 행위를 방치해 온 지자체의 소극적인 행정을 강력히 규탄했다.
화물연대에 따르면 전북지역의 한*, 대* 등 컨테이너 사업장들은 4~10%의 불법 수수료를 공제하며 많게는 월 200만 원에 달하는 금액을 징수하고 있다. 이는 상반기 유가 폭등 당시 컨테이너 화물노동자들의 평균 순소득 감소분(84만 원)의 2배가 넘는 수준이다.
수출입 컨테이너의 중심지인 부산지역 역시 사정은 마찬가지다. 부산의 컨테이너 사업장들은 최고 13%의 불법 수수료를 공제하는가 하면, 안전운임 기준에 미달하는 운임을 지급하는 행위가 빈번하게 발생하고 있다. 특히 일부 위반업체들은 정당하게 법 준수를 요구하는 화물노동자들에게 배차를 중단하는 등 보복성 노동탄압까지 자행하고 있는 것으로 드러났다.
그동안 전북도청과 부산시청 등 전국 지자체는 안전운임 위반 업체에 대해 과태료를 부과할 수 있는 직접적인 권한을 가졌음에도, 국토교통부의 구체적인 점검 기준이 없다는 이유로 지도·단속 역할을 회피해 왔다.
하지만 지난 8월 말 국토부가 전국 지자체에 '안전운임 단속 매뉴얼'과 함께 일제 단속 실시 공문을 시행함에 따라, 지자체가 단속 조치를 미룰 명분은 사라졌다.
화물연대 측은 "안전운임제가 재시행된 지 약 반년 만에 1,200건이 넘는 위반 신고가 접수됐지만, 현재까지 과태료 처분을 받은 위반업체는 단 한 곳도 없다"며 "단속 매뉴얼이 마련된 만큼, 이제는 지자체가 직접 나서야 할 때"라고 강조했다.
이어 "전국 지자체는 화물연대와의 협조 아래 지역 내 안전운임제 위반을 철저히 단속하고, 위반 업체에 대한 강력한 행정조치로 현장의 폐단을 즉각 개선해야 한다"고 촉구했다.
The Public Transport Workers' Union of the Korean Confederation of Trade Unions (Chairman Kim Dong-guk, hereinafter referred to as the Cargo Alliance) called on local governments to take strict administrative measures against unscrupulous companies that violate the safety fare system and collect illegal fees.
On the morning of the 7th, the Cargo Alliance held simultaneous press conferences in front of the Jeonbuk Provincial Office and Busan City Hall, exposing the violations of the safety fare system while strongly condemning the passive administrative actions of local governments that have allowed such illegal activities to continue.
According to the Cargo Alliance, container businesses in Jeonbuk such as A and B deduct illegal fees ranging from 4 to 10%, collecting amounts as high as 2 million won per month. This exceeds twice the average net income decrease (840,000 won) of container freight workers during the first half of the year when fuel prices surged.
The situation is similar in the Busan area, the hub of import and export containers. Some container businesses in Busan deduct up to 13% in illegal fees, and there are frequent instances of paying fares below the safety fare standards. Particularly, some violating companies have been revealed to engage in retaliatory labor suppression, such as suspending dispatches to freight workers who rightfully demand law compliance.
Despite having the direct authority to impose fines on companies violating the safety fare system, local governments nationwide, including Jeonbuk Provincial Office and Busan City Hall, have avoided their supervisory roles citing the lack of specific inspection criteria from the Ministry of Land, Infrastructure, and Transport.
However, with the Ministry of Land, Infrastructure, and Transport issuing a notice at the end of August to all local governments to implement comprehensive inspections along with the 'Safety Fare Inspection Manual,' the grounds for delaying enforcement actions have disappeared.
The Cargo Alliance stated, "Since the reintroduction of the safety fare system about six months ago, over 1,200 violation reports have been received, but not a single violating company has been fined so far," emphasizing that "now that the inspection manual is in place, it is time for local governments to take direct action."
Furthermore, they urged, "Under the cooperation with the Cargo Alliance, local governments nationwide must thoroughly crack down on violations of the safety fare system within their regions and immediately improve the on-site situation through strong administrative measures against violating companies."
