서울 중구 정동 경향신문사 빌딩 앞에서 부부가 나란히 목숨을 건 농성을 이어가고 있다. 전국공공운수사회서비스노동조합(공공운수노조) 의료연대본부 서울지역지부에서 근무했던 함계남 전 조직국장은 7일로 천막농성 15일째, 단식농성 5일째를 맞았다. 같은 노조 조직국장인 배우자 양규서 씨는 이날로 건물 외벽에 밧줄로 몸을 묶은 채 벌이는 고공단식농성 2일차에 들어섰다.

2023년 괴롭힘 신고에서 시작된 3년
이번 사태의 출발점은 2023년 1월이다. 함계남 씨는 이 시기 의료연대본부 서울지역지부에서 직장 내 괴롭힘을 겪었다며 문제를 제기했고, 같은 해 6월 고용노동부에, 7월에는 민주노총에도 진상 파악을 요구했다. 하지만 의료연대본부는 그해 3월 이를 직장 내 괴롭힘에 해당하지 않는다고 판단했다.

함씨 측은 이 과정에서 좌측염좌, 우측힘줄염, 중등도우울증에피소드 등에 대해 산업재해 승인을 받았다고 주장한다. 이후 상황은 더 악화됐다. 함씨는 2023년 4월 의료연대 서울지부 사무국 간부들로부터 권고사직을 요구받았고, 같은 해 12월 조합원에서 제명됐으며, 2024년 11월 26일 의료연대본부로부터 징계 해고를 통보받았다.

배우자 양규서 씨는 아내 문제 해결을 요구하는 항의 활동을 이어가며 스스로도 여러 차례 징계를 받았다. 공공운수노조는 2023년 10월 13일 양씨에게 정직 4개월, 2024년 5월 20일 정직 6개월, 2026년 5월 8일에도 다시 정직 6개월 징계를 내렸다. 누적 징계 기간은 16개월에 달하며, 세 번째 정직은 오는 11월 종료될 예정이다.

양씨는 이 문제로 2023년 7월부터 8월까지 46일간 공공운수노조 앞에서 옥탑농성을 벌인 바 있고, 당시 중학생이던 아들도 함께 농성장에 오른 사실이 알려지며 주목받았다. 올해 8월 5~6일에도 2차 옥탑농성을 진행했다.

방영환 열사 분신과의 연결고리
이 사건은 2023년 9월 발생한 고 방영환 열사 분신 사건과도 맞물려 있다는 지적이 나온다. 방영환 열사는 분신 직전 함계남 국장에 대한 집단 괴롭힘에 항의하는 투쟁을 지원했다는 이유로 공공운수노조 측 요구에 따라 소속 지부로부터 징계제소를 당한 것으로 알려졌다. 함씨는 성명을 통해 "고 방영환 열사의 죽음 앞에 징계를 사주했다는 의혹까지 나오는 지금, 민주노총과 공공운수노조, 의료연대, 의료연대서울지부의 간부들은 무엇을 하고 있는가"라고 물었다.

진행 중인 법적 절차
당사자들의 부당해고·부당정직 다툼은 현재 사법 절차로도 이어지고 있다. 함계남 씨의 부당해고구제 재심판정취소 사건(2025구합2931)은 중앙노동위원회위원장을 상대로, 공공운수노조 의료연대본부를 피고보조참가인으로 하여 진행 중이다. 양규서 씨의 정직 4개월·6개월 처분에 대한 부당정직구제 재심판정취소 사건은 서울고등법원(2026누5058)에서 항소심이 이어지고 있으며, 가장 최근의 정직 6개월 처분에 대해서는 별도로 서울지방노동위원회에 구제신청(서울2026부해3005)이 제기된 상태다.

대책위-민주노총 간담회, 접점 못 찾아
양대노총 직장내괴롭힘 공동대책위원회(대책위)는 지난 7월 30일 민주노총에 면담을 요청하는 공문을 보냈고, 민주노총은 8월 11일 9월 3일 오후 1시 면담을 통보했다. 이보다 앞서 8월 24일부터는 경향신문사 정문 앞 농성이 시작됐다.

9월 3일 오후 1시 30분부터 약 1시간 동안 양경수 민주노총 위원장이 참석한 간담회가 열렸다. 대책위는 이 자리에서 네 가지를 요구했다. 공공운수노조에서 해고된 함씨의 민주노총 차원 신규 채용, 양씨의 11월 정직 종료 후 추가 징계 없는 복직 및 정년 보장, 외부 전문가가 참여하는 독립적 진상조사기구 구성, 공공운수노조 직장 내 괴롭힘 관련 10대 과제에 대한 민주노총의 진상규명이었다.

민주노총은 7일 낸 보도자료에서 총연맹과 산별노조가 각각 독립적으로 운영되는 조직 구조상 개별 노조의 채용·징계 등 인사 문제에 총연맹이 직권으로 개입하거나 결과를 번복하기 어렵다는 입장을 밝혔다. 국가인권위원회나 고용노동부가 추천하는 외부 인사의 조사위원 참여도 어렵다고 했다. 다만 공공운수노조, 의료연대본부와 당사자들이 모두 전적으로 동의한다면 진상조사를 고려할 수 있다는 여지를 남겼다. 양경수 위원장은 이번 사안이 총연맹의 직권 개입으로 풀릴 문제가 아니라 당사자인 공공운수노조·의료연대본부와 당사자 간 직접 대화로 해결해야 한다는 입장을 재확인했다.

간담회 이후에도 접점을 찾지 못하면서 함씨는 삭발과 함께 단식농성에 들어갔고, 지난 6일 오전 양씨가 건물 12층 외벽에서 로프 고공농성을 시작하면서 사태는 최고조로 치달았다. 6일 오전 9시 민주노총 사무총국 간부가 현장을 찾아 대화를 시도했고, 11시에는 민주노총 임원이 양씨와 함씨, 대책위 집행위원장과 대화를 시도했으나 진전이 없었다. 민주노총은 7일에도 두 사람에게 지속적으로 대화를 요청하고 있다고 밝혔다.

소방·경찰 비상 대응 중
양씨가 12층 높이 외벽에서 밧줄에 몸을 묶은 채 농성을 벌이자 신고를 받고 출동한 소방당국은 고가사다리차를 배치하고 지상에 에어매트를 설치해 만일의 사고에 대비하고 있다. 경찰도 현장 주변 교통을 통제하고 있다. 양씨는 외벽에 "대통령님, 고용노동부 장관님 살려주세요. 민주노총이 해고하고, 징계 사주 했어요"라는 문구가 담긴 플래카드를 내걸었다.

민주노총은 보도자료에서 "노숙 단식농성과 고공 로프농성을 이어가고 있는 두 분에 대해 매우 안타깝고 유감스럽게 생각한다"며 "무엇보다 이분들의 안전이 최우선이며, 하루빨리 대화를 통해 문제가 해결되기를 바란다"고 밝혔다.

함씨는 성명을 통해 "우리가 원하는 것은 특별한 것이 아니다. 노동자를 대변한다는 조직이 노동자를 5인 미만으로 해고하고 직장 내 괴롭힘으로 짓밟는 일을 멈추라는 것, 그것 하나다"라며 "나는 이 자리를 떠나지 않을 것이다. 양규서 동지 역시 고공에서 내려오지 않을 것"이라고 밝혔다.

4. 농성자가 사다리차에 의지해있다가 현재는 줄에 의지한 채로 고공에 매달려있는 상황으로 매우 심각한 상황입니다.

A couple continues their protest risking their lives side by side in front of the Kyunghyang Shinmun Building in Jung-gu, Seoul. Ham Gye-nam, former head of the Medical Solidarity Headquarters Seoul Regional Branch of the National Public Transport and Social Service Labor Union (Public Transport Union), marked the 15th day of their tent protest and the 5th day of their hunger strike on the 7th. On the same day, his spouse, Yang Gyu-seo, also a former head of the same union, entered the second day of a high-altitude hunger strike, tying themselves to the building's exterior wall with a rope.

The starting point of this incident dates back to January 2023 when Ham Gye-nam experienced workplace harassment at the Medical Solidarity Headquarters Seoul Regional Branch during that time. He raised the issue and demanded an investigation from the Ministry of Employment and Labor in June and from the Korean Confederation of Trade Unions in July of the same year. However, the Medical Solidarity Headquarters deemed it not to be workplace harassment in March of that year.

Ham's side claims that during this process, he received industrial accident approval for left shoulder impingement, right tendonitis, and moderate depression episodes. The situation worsened thereafter. In April 2023, Ham was asked to resign by the executives of the Medical Solidarity Seoul Regional Branch office, and in the same year in December, he was expelled from the union. On November 26, 2024, he was notified of disciplinary dismissal by the Medical Solidarity Headquarters.

His spouse, Yang Gyu-seo, also faced several disciplinary actions while continuing her protest activities demanding a resolution to her husband's issues. The Public Transport Union imposed disciplinary actions on Yang on October 13, 2023, for 4 months, on May 20, 2024, for 6 months, and again on May 8, 2026, for another 6 months. The cumulative disciplinary period amounts to 16 months, and the third disciplinary action is set to end in November.

Yang conducted a rooftop protest in front of the Public Transport Union for 46 days from July to August 2023, and her involvement in the protest, along with her middle school-aged son, garnered attention. She also conducted a second rooftop protest on August 5-6 this year.

This incident is also linked to the case of the late Bang Yeong-hwan, who committed self-immolation in September 2023, as he was reportedly subjected to collective harassment for supporting the protest against the harassment of Ham Gye-nam. Ham, in a statement, questioned the actions of the Korean Confederation of Trade Unions, the Public Transport Union, the Medical Solidarity, and the Medical Solidarity Seoul Regional Branch officials, mentioning suspicions of disciplinary actions leading to Bang Yeong-hwan's death.

The unfair dismissals and disputes over wrongful employment are currently ongoing through legal proceedings. Ham Gye-nam's case of unfair dismissal (2025GuHap2931) is being pursued against the Chairman of the Central Labor Relations Commission, with the Public Transport Union's Medical Solidarity Headquarters as the co-defendant. Yang Gyu-seo's case regarding the 4 and 6-month employment decisions is under appeal at the Seoul High Court (2026Nu5058), and a separate application for relief (Seoul2026BuHae3005) has been filed regarding the most recent 6-month employment decision.

The Joint Committee of the Major Trade Unions for Workplace Harassment (Joint Committee) sent a letter to the Korean Confederation of Trade Unions on July 30 requesting a meeting, which was scheduled for September 3 at 1 pm on August 11. However, a protest began in front of the Kyunghyang Shinmun Building on August 24.

A meeting was held on September 3 at 1:30 pm with Yang Gyu-seo, the Chairman of the Korean Confederation of Trade Unions, in attendance. During the meeting, the Joint Committee made four demands, including new hiring by the Korean Confederation of Trade Unions for Ham, reinstatement without additional disciplinary action for Yang after the November employment termination, the formation of an independent investigative body with the participation of external experts, and an investigation into the top 10 issues related to workplace harassment by the Public Transport Union.

The Korean Confederation of Trade Unions stated in a press release on the 7th that due to the independent operation of the Federation and individual unions in personnel matters, it is difficult for the Federation to intervene or reverse results in the hiring and disciplinary actions of individual unions. They also mentioned the difficulty of involving external personnel recommended by the National Human Rights Commission or the Ministry of Employment and Labor in the investigation. However, they left room for the possibility of an investigation if all parties, including the Public Transport Union, the Medical Solidarity Headquarters, and the individuals involved, fully agree. Chairman Yang Gyu-seo reaffirmed the stance that this issue cannot be resolved through the Federation's intervention but through direct dialogue between the Public Transport Union, the Medical Solidarity Headquarters, and the parties involved.

Despite the meeting, no agreement was reached, leading Ham to start a hunger strike along with shaving his head, and on the morning of the 6th, Yang began a high-altitude protest by tying herself to the exterior wall of the 12th floor of the building, escalating the situation. On the morning of the 6th, at 9 am, an official from the Korean Confederation of Trade Unions attempted to engage in dialogue at the scene, and at 11 am, executives of the Korean Confederation of Trade Unions tried to talk with Yang, Ham, and the Joint Committee's executive director, but there was no progress. The Korean Confederation of Trade Unions stated that they continue to request ongoing dialogue with the two individuals.

As Yang tied herself to the exterior wall at a height of 12 floors, the fire department, responding to the report, deployed a high ladder truck and installed an air mattress on the ground to prepare for any accidents. The police also controlled traffic around the scene. Yang displayed a placard on the exterior wall stating, "Mr. President, Minister of Employment and Labor, please save me. The Korean Confederation of Trade Unions fired me and disciplined me."

The Korean Confederation of Trade Unions expressed deep regret for the ongoing rooftop and high-altitude protests by the two individuals, emphasizing the priority of their safety and hoping for a swift resolution through dialogue.

In a statement, Ham declared, "What we want is not something special. It is simply to stop the organization that claims to represent workers from firing workers with less than 5 employees and trampling them with workplace harassment. I will not leave this place. Comrade Yang Gyu-seo will also not come down from the heights."
