2021년 전북교육청 학생인권심의위원회는 ‘레드카드 사건’으로 알려진 교사의 행위를 학생 인권침해 사례로 판단했다. 당시 사건은
초등학교 저학년 학생에게 벌점제를 운영하고, 벌점을 받은 학생에게 방과 후 청소를 시키는 등 피해학생의 인격권과 휴식권을 침해하여 특별인권교육을 이수할 것을 권고한 것이었다.
또한,
저학년 학생에게 벌점제를 운영하고 신체를 특정 자세로 제한하는 생활지도 방법은 학생 자존감 저하와 학교생활 부적응 등의 피해를 유발할 수 있으므로 재발 방지를 위한 대책을 수립할 것을 권고했으며,
학교 관리자가 교사의 부적절한 교육방법 등을 학부모 민원으로 인지했음에도 즉각 시정하지 않아 반복적인 민원을 발생시켰으므로 학교 관리자가 학부모 민원에 적극적으로 대응하는 방안과 별도의 대책을 수립할 것을 교육감에게 권고한 사건이다.
이는 애초에 학부모가 교사의 부적절한 교육방법과 인권침해를 문제 삼았을 때, 학교 관리자가 사실관계를 파악하고 문제를 적극적으로 해결하려는 노력이 필요했음을 보여주는 사건이었다. 그러나 당시 학생인권교육센터가 심의한 사안을 현재의 전북교사노조와 서거석 교육감이 뒤집으려는 움직임은, 학생 인권을 무력화하려는 시도로 보인다.
레드카드 사건, 학부모의 입장에서 본 진실
학생인권심의위원회가 심의한 사안의 당사자 중 한 학부모(A)는 교사노조에서 '악성 민원인'이라 지칭받으며, 심지어
학부모가 운영하는 피부숍이 망했으면 좋겠다는 조롱과 비난까지 받아왔다. 또 다른 학부모(B)는 자녀가 2021년 당시 교사로부터 비슷한 피해를 받은 사실을 몇 년 후에야 알게 되어 소송을 제기한 상태다.
B 학부모의 입장문에 따르면, 교사는 수업 중 학생들에게
누군가 집에 가서 말하면 반 전체가 벌을 받을 것이라며 위협했다.
이로 인해 학생들은 피해를 학부모에게 제대로 말하지 못했고, 피해 학생 중 한 명은
매일 밤 죽고 싶었고, 옥상에서 떨어지려 했지만 문이 잠겨 있어서 그러지 못했다고 고백할 정도로 심각한 정신적 외상을 입었다. 해당 학생은 이후 등교 거부와 심리적 불안 증세를 보이며 장기적인 치료를 받는 상황에 놓였다.
학부모는 입장문에서 해당 교사의 문제를 학교와 교육청에 여러 차례 알렸으나, 제대로 된 조사와 조치가 이루어지지 않았다고 밝혔다. 학부모는 다음과 같은 내용으로 절박함을 호소했다.
“제 아이는 당시 심각한 정서적 외상을 입었으며, 2학년 교실에서 받은 끔찍한 기억을 견디며 살아가고 있습니다. 피해 사실을 털어놓기까지 오랜 시간이 걸렸고, 현재까지도 상담과 치료를 받고 있습니다. 그러나 교육기관들은 학생의 피해 회복에는 관심이 없고, 오히려 이의를 제기하는 ‘악성 민원인’ 취급을 하며 부모를 문제 삼고 있습니다.”
학부모는 또한 해당 교사가 방송과 언론을 통해 자신은 아무 잘못이 없다고 주장하는 모습을 보고 충격을 받았다며, 전북교사노조가 학생 인권을 무시하고 교사의 입장을 옹호하는 데만 몰두하고 있다고 비판했다.
재심의 결정, 학생 인권을 무력화하려는 시도
전북교사노조는 사건 당시 교사의 행위를 정당화하며, 학생인권심의위원회의 결정을 뒤집을 목적으로 전북의 모든 교사들을 대상으로 ‘호랑이 스티커 교사의 인권침해 판단에 대한 재심의 요구 서명 운동’을 조직적으로 벌였다. 정재석 위원장은 학부모를 '악성 민원인'으로 몰아가며, 조직적인 압박을 가했다는 의혹을 받고 있다. 특히 학부모의 직장에까지 영향을 미치며 민사소송 취하를 강요했다는 주장도 제기됐다.
이러한 교사노조의 요구를 수용한 서거석 교육감은 규정에도 없는 ‘재심의’를 지시했다. 현재 교육인권센터는 조만간 학생인권심의위원회를 소집해 재심의를 개최할 예정이다. 그러나 이 과정에서 센터 관계자는
재심의가 아니라 교육감이 당시 사안을 다시 판단하라고 지시한 것이라며, 법적 근거가 모호한 입장을 밝혔다. 이는 명백히 교육감의 직권남용 소지가 있으며, 교사노조를 등에 업고 자신을 ‘교권보호 교육감’으로 홍보하려는 의도가 엿보인다.
교육감의 책임 있는 선택이 필요하다.
2021년, 학생인권심의위원회의 결정은 피해 학생들의 고통을 고려한 신중하고 정당한 판단이었다. 서거석 교육감이 교사노조의 요구를 수용해 재심의를 결정한 것은 피해 학생과 학부모에게 2차 피해를 입힐 뿐 아니라, 학생 인권의 가치를 무너뜨리는 행위로 평가받고 있다. 교사의 반인권적 행위까지 교권보호를 명분으로 옹호하려는 것은 위험한 선례로 남을 가능성이 크다.
서거석 교육감은 정재석 위원장의 압력에 굴복하는 행보를 중단하고, 피해 학생과 학부모의 목소리를 경청해야 한다. 재심의는 철회되어야 하며, 학생 인권을 보호하고 그 가치를 지켜나가는 것이 전북 교육이 나아가야 할 방향임을 명확히 해야 한다.

This incident shows that when parents initially raised issues about the teacher's inappropriate teaching methods and human rights violations, the school administrators needed to actively understand the facts and resolve the problem. However, the current movement by the Jeonbuk Teachers' Union and Superintendent Seo Geoseok to overturn the issues reviewed by the Student Rights Education Center at that time appears to be an attempt to undermine student rights.
The Red Card Incident, The Truth from the Parents' Perspective
One of the parties involved in the case reviewed by the Student Rights Review Committee, Parent A, was referred to as a 'malicious complainant' by the Teachers' Union, and even received ridicule and criticism, wishing that the
beauty shop run by the parent would go bankrupt. Another parent, B, is currently suing after finding out years later that their child suffered similar harm from the teacher in 2021.
According to Parent B's statement, the teacher threatened the students during class, saying that
if anyone went home and talked about it, the whole class would be punished.
As a result, the students were unable to properly tell their parents about the harm they suffered, and one of the victimized students confessed that they
wanted to die every night and tried to fall from the rooftop, but couldn't because the door was locked, showing severe psychological trauma. The student has since been placed in a situation where they are refusing to go to school and showing symptoms of psychological anxiety, requiring long-term treatment.
The parents stated in their position paper that they had informed the school and the Office of Education about the teacher's problem several times, but no proper investigation or action was taken. The parents pleaded desperately with the following statement.
“My child suffered serious emotional trauma at the time and is living with the terrible memories received in the second-grade classroom. It took a long time to reveal the fact of the damage, and they are still receiving counseling and treatment. However, educational institutions are not interested in the recovery of student victims, but rather treat parents who raise objections as 'malicious complainants' and make them the problem.”
The parents were also shocked to see the teacher claiming through broadcasts and the media that they had done nothing wrong, and criticized the Jeonbuk Teachers' Union for focusing solely on defending the teacher's position, ignoring student rights.
Reconsideration Decision, an Attempt to Undermine Student Rights
The Jeonbuk Teachers' Union justified the teacher's actions at the time of the incident and organized a 'request for reconsideration of the judgment on the human rights violation of the Tiger Sticker Teacher' among all teachers in Jeonbuk. Chairman Jeong Jaeseok is suspected of pressuring the parents by labeling them as 'malicious complainants'. There were even claims that he had influenced the parents' workplaces and forced them to take legal action.
Superintendent Seo Geoseok, who accepted the demands of the Teachers' Union, ordered a 'reconsideration' that is not even stipulated in the regulations. The Education Human Rights Center is planning to convene the Student Rights Review Committee soon to hold a reconsideration. However, in this process, a center official stated that
it is not a reconsideration, but the superintendent ordered the matter to be judged again, revealing a legally ambiguous position. This clearly has the potential for abuse of the superintendent's authority, and it appears to be an attempt to promote himself as a 'superintendent protecting teacher rights' by relying on the Teachers' Union.
A Responsible Choice by the Superintendent is Needed
In 2021, the decision of the Student Rights Review Committee was a careful and fair judgment considering the pain of the victimized students. Superintendent Seo Geoseok's decision to reconsider in response to the demands of the Teachers' Union is being evaluated as an act that not only inflicts secondary damage on the victimized students and parents but also undermines the value of student rights. Advocating for teacher rights, even for teachers' anti-human rights actions, is likely to remain a dangerous precedent.
Superintendent Seo Geoseok needs to stop succumbing to the pressure from Chairman Jeong Jaeseok and listen to the voices of the victimized students and parents. The reconsideration should be withdrawn, and it should be made clear that protecting student rights and preserving their value is the direction that Jeonbuk education should go.
