서거석 전북교육감이 공직선거법 위반 혐의로 항소심에서 벌금 500만원 형을 선고받은 가운데, 대법원에서 원심 형이 확정될 경우 당선이 무효되지만, 올해 교육감 재선거는 실시되지 않는다는 점이 확인됐다.

2심 재판부인 광주고법 전주재판부는 지난 3월 서 교육감에게 당선무효형인 벌금 500만 원을 선고했다. 법원은 서 교육감이 2022년 지방선거 당시 허위사실을 공표한 혐의를 유죄로 판단했으며, "피고인은 과거 의혹에 대해 일방적 폭행 피해자라고 주장하지만, 당시 현장에 있던 교수들의 진술과 이후 행적으로 미뤄 그러한 진술을 납득하기 어렵다"며 "되레 여러 간접사실 정황을 종합해보면 피고인이 먼저 동료 교수를 손으로 폭행했고, 이후 그 교수가 피고인을 때려 쌍방 폭행이 일어났다고 보는 게 자연스럽다"라고 밝히며 판시했다.

현재 사건은 대법원에 상고돼 있으며, 공직선거법상 대법원은 2심 판결 선고일로부터 3개월 이내에 선고를 내려야 한다. 이 규정에 따라 4월 하반기에 대법원 선고가 이루어질 가능성도 배제할 수 없는 상황이다.

일부 학교 현장에서는 대법 선고가 예정된 기한 내 이루어질 경우, 오는 6월 3일 예정된 제21대 대통령선거와 전북교육감 재선거가 동시에 치러질 수 있다는 전망도 나왔다. 하지만 이러한 가능성은 선거관리위원회의 해석에 따라 불가능한 것으로 확인됐다.

전북선거관리위원회는 질의에 대한 답변을 통해 "2025년 3월 1일 이후에 실시사유가 확정된 지방자치단체장의 재·보궐선거 등은 2025년 6월 3일 실시되는 대통령선거와 동시 실시하지 않는다"고 밝혔다. 이에 따라 서거석 교육감의 당선무효가 대법원에서 4월까지 확정될 경우, 올해 6월에 대통령 선거일에 교육감 재선거는 열리지 않는다.

따라서 서 교육감의 당선이 무효로 확정되더라도, 전북교육청은 내년 6월까지 부교육감의 직무대행 체제로 운영될 전망이다.

The former education superintendent of Jeollabuk Province, Seo Geo-seok, was fined 5 million won in the appellate court for violating the Public Official Election Act. It has been confirmed that even if the original sentence is upheld by the Supreme Court, the election will not be re-held this year.

In March, the Gwangju District Court in Jeonju sentenced Seo to a fine of 5 million won for election invalidation. The court found Seo guilty of publicizing false information during the 2022 local elections and stated, "The defendant claimed to be a victim of unilateral assault in the past, but it is difficult to accept such statements based on the testimonies of professors present at the scene and subsequent actions. Considering various indirect facts, it is natural to view that the defendant first physically assaulted a fellow professor, and then the professor retaliated, leading to mutual assault."

The case is currently under appeal to the Supreme Court, which, according to the Public Official Election Act, must issue a ruling within three months from the date of the appellate court's decision. Therefore, there is a possibility that the Supreme Court ruling may be issued in the second half of April.

Some schools speculate that if the Supreme Court ruling is made within the scheduled deadline, the 21st presidential election scheduled for June 3rd could coincide with the re-election of the Jeollabuk Province education superintendent. However, this possibility has been deemed impossible according to the interpretation of the Election Management Committee.

The Jeollabuk Election Management Committee stated in response to inquiries that "Re-elections or by-elections for local government heads confirmed after March 1, 2025, will not be held concurrently with the presidential election on June 3, 2025." Therefore, if Seo Geo-seok's election invalidation is confirmed by the Supreme Court by April, there will be no re-election for the education superintendent on the presidential election day in June this year.

Hence, even if Seo's election is invalidated, the Jeollabuk Provincial Office of Education is expected to operate under the acting duties of the vice superintendent until June of next year.
