보건복지부는 오는 4월 23일부터 장애인 보조견의 동반출입을 보다 명확히 보장하는 내용의 「장애인복지법 시행령」 및 「시행규칙」 일부개정령이 시행된다고 밝혔다. 이는 지난해 10월 22일 개정된 본법의 후속조치로, 장애인의 이동권 보장과 사회적 인식 개선을 위한 법적 기반을 구체화한 것이다.

개정된 시행령에 따르면, 국가 및 지방자치단체는 장애인 보조견에 대한 인식개선 홍보사업을 실시할 때 △보조견의 필요성, △출입 거부 금지에 관한 사항, △그 외 인식개선에 필요한 내용을 포함해야 한다. 이 홍보는 영상·간행물 제작·배포, 인식개선 교육 등 다양한 방식으로 이루어지며, 기존의 장애인 인식개선 홍보사업과 연계해 추진할 수 있다.

시행규칙에서는 보조견의 출입을 제한할 수 있는 ‘정당한 사유’를 명확히 규정했다. 구체적으로는 감염관리를 위한 무균실·수술실 등 의료기관의 특수 공간, 위생관리를 위한 식품 조리장·창고 등의 출입만 예외적으로 제한할 수 있다.

현행 장애인복지법 제40조 제3항은 정당한 사유 없이 장애인 보조견의 동반출입을 거부할 수 없도록 규정하고 있으며, 이를 위반할 경우 최대 300만 원의 과태료가 부과된다. 그럼에도 불구하고 여전히 일부 대중교통, 상점, 식당 등에서 동반출입을 거부하는 사례가 발생하고 있다.

보건복지부 손호준 장애인정책국장은 “이번 개정으로 장애인의 이동권 보장은 물론, 보조견 동반출입과 관련된 불필요한 갈등이 줄어들 것으로 기대한다”며 “식약처, 국토부 등 관계부처 및 지자체와 협력해 현장의 인식 개선을 위한 SNS 콘텐츠와 홍보 영상을 지속적으로 확산하겠다”고 밝혔다.

The Ministry of Health and Welfare announced that partial amendments to the Enforcement Decree and Enforcement Rules of the Disability Welfare Act, which more clearly guarantee the entry and exit of assistance dogs for people with disabilities, will be implemented starting April 23. This is a follow-up measure to the amendment of the main law in October last year, aimed at solidifying the legal basis for ensuring the right of movement for people with disabilities and improving social awareness.

According to the amended Enforcement Decree, when conducting promotional activities for improving awareness of assistance dogs for people with disabilities, the central and local governments must include information on the necessity of assistance dogs, prohibition of entry refusal, and other necessary content for awareness improvement. This promotion can be carried out through various methods such as producing and distributing videos and publications, and providing awareness improvement education, and can be linked to existing promotional activities for improving awareness of people with disabilities.

In the Enforcement Rules, 'legitimate reasons' for restricting the entry of assistance dogs have been clearly defined. Specifically, entry to special spaces in medical institutions such as sterile rooms and operating rooms for infection control, and areas like food preparation rooms and warehouses for hygiene management, can be restricted only in exceptional cases.

Article 40, Paragraph 3 of the current Disability Welfare Act stipulates that entry and exit with assistance dogs for people with disabilities cannot be refused without legitimate reasons, and a maximum fine of 3 million won can be imposed for violations. Nevertheless, cases of refusal of entry and exit with assistance dogs still occur in some public transportation, shops, and restaurants.

Son Ho-jun, Director of the Disability Policy Division at the Ministry of Health and Welfare, stated, "With these amendments, we expect unnecessary conflicts related to the entry and exit of assistance dogs for people with disabilities to decrease, in addition to ensuring the right of movement for people with disabilities." He also mentioned, "We will continue to spread SNS content and promotional videos for on-site awareness improvement in collaboration with relevant ministries, local governments, and agencies such as the Korea Food and Drug Administration and the Ministry of Land, Infrastructure and Transport."
