보건복지부는 4일부터 7월 14일까지 『발달장애인 권리보장 및 지원에 관한 법률』(약칭: 발달장애인법) 시행령 및 시행규칙 일부개정안을 입법 예고한다고 밝혔다.

이번 개정안은 지난 4월 1일 개정된 발달장애인법에 따라 재산관리 지원서비스 제공과 지방자치단체의 지역발달장애인지원센터 설치에 관한 법적 근거가 마련됨에 따라, 이에 따른 하위법령을 정비하는 차원에서 추진됐다.

개정안의 주요 내용은 다음과 같다.

첫째, 발달장애인을 위한 재산관리 지원서비스의 구체적 절차가 새롭게 마련됐다. 이용 신청부터 서비스 계약 체결, 재산 관리 방식, 계약 해지 및 종료 절차 등 전반적인 운영 방안이 규정된다. (시행규칙 제19조의5 신설)

둘째, 재산관리 지원서비스 제공 업무는 국민연금공단에 위탁되며, 공단이 서비스를 수행하는 과정에서 발달장애인의 민감정보 및 고유식별정보를 처리할 수 있는 법적 근거도 함께 신설된다. (시행령 제16조의2 제3항 및 제16조의3 신설, 제17조 개정)

셋째, 지방자치단체장이 설치하는 지역발달장애인지원센터의 조직 및 운영에 관한 사항은 각 지자체 조례로 정하도록 하고, 이 센터의 운영은 한국장애인개발원에 위탁할 수 있도록 명시했다. (시행령 제16조의2 제2항, 시행규칙 제23조 제4항 개정)

보건복지부 관계자는 “이번 개정은 발달장애인이 보다 체계적이고 안정적인 지원을 받을 수 있도록 제도적 기반을 마련하기 위한 조치”라며, “입법예고 기간 동안 국민들의 다양한 의견을 수렴해 제도에 충실히 반영할 계획”이라고 밝혔다.

개정안에 대한 의견은 7월 14일까지 보건복지부 장애인서비스과 또는 국민참여입법센터를 통해 제출할 수 있다.

The Ministry of Health and Welfare announced that it will give legislative notice of amendments to the Enforcement Decree and Enforcement Rules of the Act on the Welfare of Persons with Developmental Disabilities (commonly known as the Developmental Disabilities Act) from April 4 to July 14.

These amendments are being pursued to revise subordinate regulations in accordance with the legal basis established for property management support services and the installation of local developmental disability support centers by local governments, as stipulated in the Developmental Disabilities Act amended on April 1.

The main contents of the amendments are as follows:

First, specific procedures for property management support services for individuals with developmental disabilities have been newly established. The overall operational guidelines, from application to service contract signing, property management methods, contract termination, and closure procedures, are specified (newly added Article 19-5 of the Enforcement Rules).

Second, the provision of property management support services will be entrusted to the National Pension Service, and legal grounds for the handling of sensitive and unique identification information of individuals with developmental disabilities by the service will be newly established (newly added Paragraph 3 of Article 16-2 and newly added Article 16-3, and amended Article 17 of the Enforcement Decree).

Third, matters related to the organization and operation of local developmental disability support centers established by local government heads will be stipulated in each local ordinance, and the operation of these centers may be entrusted to the Korea Disabled People's Development Institute (amended Paragraph 2 of Article 16-2 of the Enforcement Decree and amended Paragraph 4 of Article 23 of the Enforcement Rules).

An official from the Ministry of Health and Welfare stated, "These amendments are measures to establish a systemic and stable institutional foundation for individuals with developmental disabilities to receive more systematic and stable support," and added, "During the legislative notice period, we plan to thoroughly reflect various opinions of the public in the system."

Opinions on the amendments can be submitted to the Disability Services Division of the Ministry of Health and Welfare or the National Participation Legislation Center until July 14.
