서부지방법원 폭동 사태를 기록하기 위해 현장에 들어갔던 다큐멘터리 감독 정윤석 씨에 대해 검찰이 징역 1년을 구형한 가운데, 50여 개가 넘는 예술·시민사회 단체와 만여 명이 그의 무죄를 촉구하며 연대의 뜻을 밝혔다.

한국독립영화협회는 23일 “정윤석 감독에 대한 검찰의 기소는 카메라를 든 예술가를 폭도로 몰아간 명백한 표현의 자유 침해 사례”라며, “7월 21일까지 총 54개 단체와 10,108명의 시민이 무죄를 촉구하는 성명서에 연명했다”고 밝혔다.

정 감독은 다큐멘터리 , <논픽션 다이어리>, <밤섬해적단 서울불바다>, <진리에게> 등 사회적 주제를 다룬 작품으로 국내외 영화제에서 주목받아온 창작자다. 그는 용산 참사, 세월호 참사, 이태원 참사 등 지난 20년간 한국 사회의 주요한 비극적 사건을 현장에서 기록해왔다.

협회에 따르면 정 감독은 서부지법 폭동 현장에서도 “민주주의의 위기가 현실이 되는 순간을 예술가의 책무로 기록해야 한다”는 신념으로 카메라를 들었으며, 이는 공익적 취재와 예술 활동의 일환이었다. 그러나 검찰은 이를 인정하지 않고, ‘특수건조물침입’ 혐의로 기소해 지난 7일 징역 1년을 구형했다.

정 감독은 법정 최후진술에서 “같은 날, 같은 장소에서 같은 사건을 목격하고 촬영한 두 사람이 있다. JTBC 기자는 보도상을 수상했고, 나는 피고인의 자리에 섰다”며 “예술가는 왜 역사 기록 앞에서 배제되어야 하는가. 이는 헌법적 가치인 예술의 자유에 대한 심도 깊은 논의가 필요한 지점”이라고 강조했다. 이어 “예술가는 무죄를 주장하지 않는다. 검찰이 유죄를 주장할 뿐이다”라는 말로 발언을 마무리했다.

정윤석 감독에 대한 1심 선고는 오는 8월 1일 서울서부지방법원에서 내려질 예정이다.

Prosecutors have sentenced documentary director Jung Yoon-seok to one year in prison for entering the scene of the Western District Court riots to record the unrest. In response, over 50 arts and civil society organizations, along with thousands of individuals, have expressed solidarity by urging his innocence.

The Korean Independent Film Association stated on the 23rd, "The prosecution of Director Jung Yoon-seok is a clear infringement of freedom of expression, as it unjustly labels an artist with a camera as a rioter," adding, "As of July 21, a total of 54 organizations and 10,108 citizens have signed a statement calling for his innocence."

Director Jung is a respected creator known for his works such as documentaries like "Jam Docu Gangjeong," "Nonfiction Diary," "Night Pirate Ship Seoul Fire Sea," and "To the Truth," which tackle social issues and have garnered attention at domestic and international film festivals. Over the past 20 years, he has been documenting major tragic events in Korean society, including the Yongsan tragedy, Sewol ferry disaster, and Itaewon tragedy.

According to the association, Director Jung believed that "artists have a duty to record moments when the crisis of democracy becomes a reality," and he carried his camera at the scene of the Western District Court riots, viewing it as a combination of public interest reporting and artistic activity. However, the prosecution did not acknowledge this and charged him with 'trespassing on special facilities,' sentencing him to one year in prison on July 7.

In his final statement in court, Director Jung emphasized, "There are two people who witnessed and filmed the same incident at the same place on the same day. A JTBC reporter received an award for reporting, while I stood in the defendant's position," questioning, "Why should artists be excluded from recording history? This is a point that requires a profound discussion on the constitutional value of artistic freedom." He concluded by stating, "An artist does not claim innocence. It is the prosecution that claims guilt."

The first-instance ruling on Director Jung Yoon-seok is expected to be delivered on August 1 at the Seoul Western District Court.
