제46회 장애인의 날인 20일, 전북 지역 장애인단체가 장애인 거주시설 내 인권침해 문제 해결과 탈시설 정책 추진을 촉구하고 나섰다.

전북장애인차별철폐연대는 이날 성명을 통해 최근 장애인 거주시설에서 발생한 성폭력 사건과 관련해 강력한 대책 마련을 요구했다.

앞서 지난 15일 전주지방법원은 장애인을 성추행한 정읍 소재 장애인 거주시설 ‘화평의집’ 원장에게 징역 5년의 실형을 선고하고, 성폭력 치료 프로그램 이수와 장애인 관련 기관 취업 제한을 명령했다.

단체는 “시설장이 자신의 지위를 이용해 거주 장애인을 성추행한 사건으로, 장애인 보호를 명목으로 운영되는 시설의 폐쇄성과 권력 구조가 낳은 참혹한 결과”라고 비판했다. 특히 과거 광주 도가니 사건과 인천 색동원 사건을 언급하며, 유사한 인권침해가 반복되고 있다고 지적했다.

또한 시설장이 지자체의 시설 폐쇄 행정처분에 불복해 행정소송을 제기한 데 대해 “범죄가 발생한 시설의 존속은 어떠한 이유로도 정당화될 수 없다”며 “법원은 해당 소송을 신속히 기각해야 한다”고 주장했다.

이와 함께 정읍시와 전라북도를 향해 “시설에 남아 있는 장애인 전원을 자립지원 대상에 포함해 지역사회로의 복귀를 적극 지원해야 한다”고 요구했다.

단체는 “장애인을 시설에 수용하는 구조가 지속되는 한 폭력은 반복될 수밖에 없다”며 “단순한 시설 폐쇄나 가해자 처벌을 넘어 탈시설과 자립 지원이 근본적인 해결책”이라고 강조했다.

이어 “장애인의 날을 맞아 우리 사회가 장애인 시설 중심의 복지 구조를 되돌아봐야 한다”며 “화평의집 거주 장애인들이 지역사회의 구성원으로 살아갈 수 있도록 끝까지 대응해 나갈 것”이라고 밝혔다.

On the 20th, in celebration of the 46th Disability Day, disability organizations in Jeonbuk region urged for the resolution of human rights violations within disability residential facilities and the promotion of deinstitutionalization policies.

The Jeonbuk Alliance for the Elimination of Disability Discrimination demanded strong measures be taken in response to recent incidents of sexual violence in disability residential facilities, as stated in their declaration on that day.

Earlier, on the 15th, the Jeonju District Court sentenced the director of the disability residential facility 'Hwapyung's House' in Jeongeup, who sexually assaulted a disabled person, to 5 years in prison, completion of a sexual violence treatment program, and imposed restrictions on employment in disability-related institutions.

The organization criticized, "The incident of sexual assault by the facility director taking advantage of his position over the resident disabled individuals reflects the tragic consequences of the closed nature of facilities operated under the guise of protecting disabled persons and the power structure." They specifically mentioned past incidents like the Gwangju Dogani case and the Incheon Saekdongwon case, pointing out the recurring similar human rights violations.

Moreover, they argued, "The existence of the facility where the crime occurred cannot be justified for any reason," and insisted that "the court should promptly dismiss the administrative lawsuit filed by the facility director against the closure order by the local government."

Additionally, they demanded that Jeongeup City and Jeollabuk-do actively support the return of all remaining disabled individuals in the facility to the community as beneficiaries of independent living support.

The organization emphasized, "As long as the structure of admitting disabled individuals to facilities continues, violence will inevitably recur," and stressed that "deinstitutionalization and independent living support go beyond mere closure of facilities or punishment of perpetrators as fundamental solutions."

They further stated, "On Disability Day, our society should reflect on the welfare structure centered around disability facilities," and declared, "We will continue to respond until the disabled individuals residing in Hwapyung's House can live as members of the local community."
